grant is "prejudicial or inconvenient to His Majesty's

subjects in general," the Letters Patent shall forth-

with determine and be void to all intents and purposes.

It clearly must be strategically prejudicial

to the Empire as a whole if the Patentee, is permitted

to send out and receive uncontrolled wireless messages

from and to HongKong and places beyond HongKong in view

of the fact that it is an Imperial Fortress and Naval

Station.

If, however, the Patentee is permitted to use

the invention "within the Colony" it will in practice

be impossible to prevent messages being seat to and

received from places "beyond" HongKong.

It follows that the uncontrolled use of the

invention even though its use shall nominally be res-

tricted to places "within" the Colony cannot but cons-

titute a grave Imperial strategic danger, prejudicial

to all His Majesty's subjects in the Colony in common

with all others His subjects throughout His Dominions.

While therefore the Patentee cannot lawfully

be prevented from establishing a station and using his

invention within the Colony so long as his patent

remains unrevoked, I advise that a petition be present-

ed to the Supreme Court for revocation, and if need be for an interia injunction against the use of the inven-

tion notwithstanding the existence of the patent, on

the general public grounds that I have stated.
